These terms govern your use of Clay App, a product of Alt F Awesome (altfawesome.com). Clay App is a software-as-a-service platform for gyms, pilates studios and boutique fitness operators.
1. Who we are
Clay App is a product of Alt F Awesome, registered with the Dutch Chamber of Commerce (KvK) under number 96640413, VAT number NL005222275B75, with its registered office at Wijttenbachstraat 50, 1093 JD Amsterdam, the Netherlands. References to "we", "us", "Clay" or "the platform" mean Alt F Awesome trading as Clay App. "You" or "customer" means the gym owner or organisation that subscribes to Clay; "member" means an end-user who books a class or membership through one of those gyms.
2. The product
Clay provides a whitelabel booking and membership platform with a dedicated subdomain per customer, a Progressive Web App for members, an admin portal and a Stripe Connect integration so that payments arrive directly in the customer's own Stripe account.
3. Account and use
The customer is responsible for the accuracy of the data provided, the content published on its tenant subdomain and the secure handling of staff credentials. Misuse, unlawful content or breach of these terms can result in suspension of the account.
4. Payments and billing
Clay charges a fixed monthly fee plus a 1.5% transaction fee on processed bookings. All payments are processed by Stripe under its own terms, including Stripe's own transaction fees. The subscription is billed monthly in advance via the customer's Stripe account.
5. Availability
We aim for a minimum uptime of 99.5%. Planned maintenance is announced in advance where possible. We are not liable for downtime caused by third parties such as Stripe, Vercel, Render or the internet connection of the customer or member.
6. Termination
The subscription can be cancelled monthly via the admin portal. Access to the platform remains available until the end of the current billing period. Customer data is retained for thirty days after termination so that an export can be provided; afterwards it is permanently deleted.
7. Liability
Our total liability per event is limited to the amount the customer paid to Clay during the three months preceding the event causing the damage. Indirect damages, consequential losses and lost revenue are excluded to the extent permitted by law.
8. Governing law
These terms are governed by Dutch law. Disputes will be submitted to the competent court in the district where Clay has its statutory seat.
